Fergus comes up and moves to the left rear of the brother letting others talk to the man. He keeps his guard up so that his shield is between him and the man and his sword up in the high guard position. He is not being aggressive with the man instead simply trying to hold him place. At least he is away from the pilgrims so no more harm can befall them. Murder??? How many did they lose and what was is purpose for doing it? He seems so harmless...more concerned with us and his fellows????

Does it look like there's an animal or travel companion with the pilgrims or Mathias? I'm just curious if speak with animals might be useful by learning what an animal traveling with Mathias could tell us of his actions?

Smite Evil (Su)
Once per day, a paladin can call out to the powers of good to aid her in her struggle against evil. As a swift action, the paladin chooses one target within sight to smite. If this target is evil, the paladin adds her Cha bonus (if any) to her attack rolls and adds her paladin level to all damage rolls made against the target of her smite. If the target of smite evil is an outsider with the evil subtype, an evil-aligned dragon, or an undead creature, the bonus to damage on the first successful attack increases to 2 points of damage per level the paladin possesses. Regardless of the target, smite evil attacks automatically bypass any DR the creature might possess.
In addition, while smite evil is in effect, the paladin gains a deflection bonus equal to her Charisma modifier (if any) to her AC against attacks made by the target of the smite. If the paladin targets a creature that is not evil, the smite is wasted with no effect.
The smite evil effect remains until the target of the smite is dead or the next time the paladin rests and regains her uses of this ability. At 4th level, and at every three levels thereafter, the paladin may smite evil one additional time per day, as indicated on Table: Paladin, to a maximum of seven times per day at 19th level.

A bhut is a very rare creature that can take the guise of a human during the day. During the night it transforms into a fearsome humanoid creature. It's cowardly to a tee and it fights only when cornered, like a wild animal. The bhut has teeth and claws.

Just for clarification sake...we are in a surprise round. Which means the current surprise round Fergus has an (8) correct? So I have not gone and when I do that will be the action I wrote up that he will take. After that we will move into the first round...which Fergus has a (20)...is this correct? Sorry, I am just a bit confused and wanted to make sure I was on the right track of thinking.

Fergus missing and seeing that no one else was able to strike true he decides to reposition himself directly behind Brother Mathies. AS he slides left he uses the momentum and drives his hip and legs pivoting hard on his back foot and takes a hard horizontal swing aiming for the creatures torso as he brings his shield in towards his off side tucked into his lower torso and hip. Hoping to sink his blade into the creature's soft organs and end the fight quickly.

Fergus gives Third a nodding approval as he wipes his hatchet and puts it away. He walks over picks up his longsword and then inspects the body of the creature...the now deceased Brother Mathias. "May your soul find peace and the darkness wash away from you Brother Mathias." He inspects the body closely without touching it...not sure if Brother Mathias was human and cursed or he was this creature and using Brother Mathias as some sort of disguise. May Bahamut bless us and keep us safe. We will need it if there are more of these things.
He once again looks over the creature and tries to sense if it is still evil or if this presence of evil is now gone?
