Regarding the guard: As long as noone disturbs his attempts to sleep (or the sleep that will follow), he'll continue to do that for the entire 8-hour duration of the suggestion spell. Attempting to tie him up would likely be such a disturbance unless done very carefully (he'd no longer think it reasonable to take a nap when people try to tie him up).

Derek and Xerath notice the small orb, now that all the thieves are down, fly from its spying place towards and through an arrow slit in the wall.

As the last foe falls, Maddok's battle-rage subsides. Feeling the fullness of his injuries now, the big Shoanti's frame sags a bit.
Maddok nods his thanks to Appario for slaying the enemy that had stood at his back and moves into the other room to make sure everyone is up and safe.
The spirit-hound checks each foe for signs of life.

By the way, if Derek or Xerath wants to do something about the flying orb, it's a DC 15 Perception check to find it again about 20 ft out from the arrow slit before it flies even further away and vanishes from sight.

Derek unable to come up with a way to stop the orb from dissapearing curses softly.
"I believe it was a magical spying orb. It may even have been the "boss" of this place watching us fight so he could form a strategy against us later.
It probably noticed us noticing it and fleed, but my guess is that it will be back to try again later.
As long as it is around, the "boss" will always know where we are and can set traps and ambushes for us."

However, their surprise quickly fades as they react to the new situation. Each of the thieves fires his crossbow at Appario, then two of them drop the ranged weapon to draw a rapier while moving to prevent easy entry into the room. The last thief reloads his crossbow.

Hmm. Reposition doesn't allow for swapping positions, only for moving the target (very few things in the game allow anyone to swap positions; as far as I know, there's only the "Swap Places" teamwork feat).
I'll say the best Maddok can do is move the thief to R25, but that should work just as well (apart from the archon's attack, but it could simply delay to achieve the same thing).
That also means Maddok has to use a regular move to get inside the room, and will suffer an AoO for movement from thief #2.
