Paizo, Inc. and its affiliates (“we,” “us,” “Paizo”) reserve the right to revise these Terms at any time. Each time you visit the Site, you are accepting the Terms in effect at that time. Please review these Terms from time to time as we may update them periodically.

Your use of and engagement with the Site may also be governed by one or more of our additional policies, including our Privacy Policy, Community Guidelines, and Paizo’s other policies and public licenses, or any other rules or policies we may make available from time to time (the “Policies”).

The Site is not intended for children under the age of 16. You hereby affirm that you are an adult of legal age in your country and state of residence. If you are under the legal age, your parent or guardian must consent to these Terms both directly and on your behalf.

Your Account

While some elements of the Site may be accessible to the public, certain elements require that you create an account (“Account”). To register an Account and access certain services through the Site, you may be asked to provide your date of birth, name, email address, and other personal information. Paizo will use and protect personal information subject to our Privacy Policy.

You are fully responsible for maintaining the confidentiality and security of your Account password and access information. You may not share your Account or access information. Two or more people may not use the same Account or access the Site as the same user. You agree to notify us immediately if you suspect any unauthorized use of your Account. You further agree that you are entirely liable for all activities conducted through your Account, and are responsible for ensuring that you or your child is aware of, understands, and complies with these Terms and the Policies.

Use of the Site is void where prohibited. By registering an Account and accessing the Site, you represent and warrant that: (i) all Account data that you submit is truthful and accurate; (ii) you are the age of consent or older in your country/region, or have your parent or guardian's consent; (iii) your use of the Site will not violate any applicable law or regulation, these Terms, or the Policies; and (iv) you are not an individual specifically banned or prohibited by us from registering an Account or using the Site.

You have no property or ownership rights or interest whatsoever in your Account. You understand and agree that Paizo and our representatives will have access to your Account and are able to track your use and engagement with the Site. You authorize us and our representatives to review such information as reasonably necessary to investigate complaints, to provide you with services, and for other purposes as set forth in these Terms, our Privacy Policy, and other applicable Policies.

Ownership of Content and Grant of Conditional License

All right, title, and interest in the Site and in all materials or services provided through the Site (including all data, text, templates, forms, designs, pages, print screens, audio and video clips, images, artwork, photographs, source code, or software that resides or is viewable or otherwise discoverable on or through the Site) (the “Content”) belongs to us or to our valid third party licensors.

Except as expressly provided below, nothing contained in this Site shall be construed as conferring any license or right, expressly, by implication, by estoppel or otherwise, under any of our intellectual property rights, or under any third party’s intellectual property rights, and no part of the Site or Content may be reproduced, republished, copied, transmitted, or distributed in any form or by any means, except in accordance with applicable Policies or otherwise with our prior written consent.

Upon your acceptance of these Terms, we hereby grant you a nonexclusive, nontransferable, limited, conditional license to view, use, access, and engage with the Site and Content only for your personal use and only as permitted by these Terms and applicable Policies. As a condition of this license, and by visiting or using the Site, you agree that you will comply with all applicable laws, rules, and regulations, including our Policies, and you additionally agree that you shall not:

• Use the Site to engage in or endorse any cheating or hacking, including by creating, offering, promoting, distributing, or making available any cheats, bots, hacks, or device, software, code, or program that grants or is designed to grant any user an advantage over others not using such methods, or impersonating another user or accessing another user’s account without their permission;
• Submit any software or other materials that contain any viruses, malware, spyware, or other programs or code of a malicious or destructive nature;
• Reproduce, modify, display, publicly perform, distribute, or create derivative works of the Site or the Content, unless otherwise authorized by our Policies;
• Modify, adapt, sub-license, translate, sell, reverse engineer, decompile or disassemble any portion of the Site or otherwise attempt to derive any source code or underlying ideas or algorithms of any part of the Content, unless otherwise authorized by our Policies;
• Take any action that imposes or may impose (in our sole discretion) an unreasonable or disproportionately large load on our infrastructure;
• Attempt to conceal your identity by using multiple Internet Protocol addresses, email addresses, or other unauthorized means to conduct transactions on the Site;
• Decode, decrypt, modify, or reverse engineer any underlying algorithms or barcodes used on or in production of the Content or the Site; or
• Use the Site or the Content in an attempt to, or in conjunction with, any device, program or service designed to circumvent any technological measure that effectively controls access to, or the rights in, the Site and/or Content in any way including, without limitation, by manual or automatic device or process, for any purpose.

This license is expressly conditioned on your agreement to comply with, and your actual compliance with, each of the provisions described in these Terms. This license exists only so long as you strictly comply with each of the provisions described herein. Any use of the Site or its Content by you or anyone acting on your behalf that does not comply with these Terms exceeds the scope of the license granted to you herein, constitutes unauthorized reproduction, distribution, display, or creation of unauthorized derivative versions of the Site and Content, and infringes our copyrights, trademarks, patents and other rights in the Site and Content.

User Content

The Site or Content may enable you to submit, post, upload, fill-in, comment, or otherwise make available (“Post”) content such as questions, messages, ideas, suggestions, feedback, comments, and other content (“User Content”). If you Post User Content, you grant us a nonexclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to access, view, use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, copy, and display such User content in any form, media, or technology now known or hereafter developed. You represent and warrant that: (i) you own or control all of the rights to the User Content that you Post; (ii) the User Content you Post is truthful and accurate; and (iii) the User Content you Post does not violate these Terms, the Policies, or any applicable laws.

Payment Terms

Paizo uses third party payment providers and trusted partners to authenticate payment when you purchase our products, to assist with our webstore and ecommerce system, and to help provide and deliver products and services you may request or access through the Site (“Third Party Partners”). When you purchase products or services from the Site, you are interacting with our Third-Party Partners. Please read the terms and conditions and privacy policies of these Third-Party Partners to understand any additional terms that may apply to your transactions and interactions with the Third Party Partners. All actions and uses you undertake with respect to services offered by our Third-Party Partners must comply with the applicable terms of service for that Third Party Partner.

When you set up an Account with us or use the Site or the services of our Third-Party Partners, you must provide accurate and complete information for a valid payment method that you are authorized to use. You are responsible for ensuring that you have authorization to use any chosen payment method, which includes obtaining account-holder, parent, or guardian approval if applicable. We will bill you through the payment method you provide, and you hereby authorize us and our Third-Party Partners to charge your payment method in accordance with the payment terms herein. YOU AGREE THAT ANY LOSS, DAMAGE, OR HARM YOU SUFFER IS NOT IRREPARABLE AND OTHER REMEDIES WOULD BE ADEQUATE SUCH THAT YOU ARE NOT ENTITLED TO AND HEREBY WAIVE ANY RIGHT TO EQUITABLE RELIEF INCLUDING, WITHOUT LIMITATION, INJUNCTIVE RELIEF AGAINST US AND OUR PARENTS OR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS TO ENFORCE THE TERMS HEREOF; HOWEVER, YOU AGREE THAT PAIZO AND/OR ITS LICENSORS WOULD BE IRREPARABLY HARMED IF THE TERMS OF THIS AGREEMENT WERE NOT SPECIFICALLY ENFORCED THEREFORE THE FOREGOING SHALL NOT PRECLUDE PAIZO FROM SEEKING ANY INJUNCTIVE RELIEF. THIS LIMITATION APPLIES TO ALL CAUSES OF ACTION OR CLAIMS IN THE AGGREGATE FOR ANY REASON.

Limitations on Warranty, Waiver, Liability

Some jurisdictions do not allow the foregoing limitations of liability, disclaimers of warranty, or indemnification provisions. As such, they may not apply to you in their entirety.

Governing Laws in Case of Dispute

These Terms shall be governed and construed in accordance with the laws of the State of Washington, USA. Disputes arising from these Terms shall be exclusively subject to the jurisdiction of the State and Federal Courts located in King County, Washington. You hereby consent to the jurisdiction of such courts, and hereby waive any claims to forum non conveniens.

Construction

These Terms incorporate by reference any notices or Policies on the Site and constitute the entire agreement with respect to your access to and use of this Site. Any provision of these Terms which is determined by a court of competent jurisdiction to be unenforceable in any jurisdiction shall be severable from these Terms in that jurisdiction without in any way invalidating the remaining provisions of these Terms. The unenforceability of any provision in a given jurisdiction shall not make that provision unenforceable in any other jurisdiction.

PAIZO PLUS LOYALTY PROGRAM

TERMS AND CONDITIONS

(Updated and effective as of November 17, 2025)

 1.      GENERALLY: 

The Paizo Plus Loyalty Program (“Loyalty Program”) is a customer loyalty program offered and sponsored by Paizo Inc. (“Paizo”) that allows qualifying participants (“Members”) to obtain Gold (as defined below) for making qualifying purchases and participating in various activities and offers set forth by Paizo from time to time, and allows Members to obtain special Rewards (as defined below) and other benefits offered under the Loyalty Program. The purpose of the Loyalty Program is to reward and thank Paizo customers. NO PURCHASE OR PAYMENT OF ANY KIND IS REQUIRED IN ORDER TO BECOME A MEMBER OF THE LOYALTY PROGRAM OR PARTICIPATE IN THE LOYALTY PROGRAM AT THE EXPERT MEMBERSHIP TIER. AND YOU ARE NOT REQUIRED TO BECOME A MEMBER OF THE LOYALTY PROGRAM IN ORDER TO PURCHASE PRODUCTS FROM PAIZO. The Loyalty Program is offered solely to natural persons who are eighteen (18) years of age or older and meet all of the eligibility requirements set forth in Section 3 below. Participation in the Loyalty Program is limited to Members of the Loyalty Program.

The Loyalty Program is offered and effective as of the “updated and effective” date above (the “Effective Date”) and shall continue until such time as it is terminated by Paizo (the “Program Term”). The Loyalty Program is offered solely at the discretion of Paizo and Paizo may modify, amend, change, suspend or terminate the Loyalty Program at any time, for any reason, with or without notice, without any liability. That includes, but is not limited to, the right to (a) discontinue or alter membership tiers or structure, (b) change the expiration date or redemption value of Gold or Rewards, (c) merge the Loyalty Program with another rewards program, or (d) adjust how Gold or Rewards are obtained, calculated or redeemed.

2.       GOVERNING TERMS AND CONDITIONS:

The Loyalty Program is governed by these terms and conditions (the “Terms and Conditions”), the terms of use for paizo.com (the “Rewards Website”) found at paizo.com/paizo/termsofuse (“Terms of Use”), and Paizo’s privacy policy found at paizo.com/paizo/privacy (the “Privacy Policy”). As of the Effective Date these Terms and Conditions supersede any prior version of the Terms and Conditions in effect for the Loyalty Program, if any. BY BECOMING A MEMBER OF THE LOYALTY PROGRAM OR PARTICIPATING IN THE LOYALTY PROGRAM, EACH MEMBER OR PARTICIPANT AGREES TO BE LEGALLY BOUND BY THESE TERMS AND CONDITIONS, AND ANY UPDATES OR REVISIONS THERETO, AS THEY BECOME EFFECTIVE, WITH OR WITHOUT NOTICE OF SUCH UPDATES OR REVISIONS.

3.       MEMBERSHIP ELIGIBILITY: 

To be eligible for membership in the Loyalty Program, you must: (a) be a natural person, (b) who is not already enrolled in the Loyalty program, (c) of eighteen (18) years of age or older, and (d) who will not use the Loyalty Program to violate applicable laws. Membership is only open to persons who meet all of the above criteria. The Loyalty Program is void where prohibited.

4.       HOW TO BECOME A MEMBER:

If you meet all of the membership eligibility criteria in Section 3, then you may become a Member by visiting the Rewards Website and creating a Paizo account (“Account”) by providing all required information pursuant to the Terms of Use. All information you provide must be complete and accurate. To join the Loyalty Program, you must maintain a valid email address. It is your responsibility to keep us updated if your email address changes. You can update your email address or other Account information by logging in through the Rewards Website and changing your account preferences or emailing our customer service team at customer.service@paizo.com. All information submitted at the Rewards Website is subject to, and will be treated in a manner consistent with, the Terms of Use and Privacy Policy. If Paizo determines, in its sole discretion, that the information is incorrect or incomplete, or that you are ineligible for membership, then Paizo may refuse to grant membership, or may terminate or suspend your Account.

There is a limit of one membership per Account and a limit of one Account per person and per email address. Any attempt to obtain (or any collaboration with or assistance of others in an attempt to obtain) more than one membership per person and per email address, whether by using multiple names or multiple email addresses, or via any other means, will result in disqualification from membership and participation in the Loyalty Program, and/or suspension or termination of any related Account(s). No membership and no Account is valid or in effect until such time as Paizo has received all information required during the Account registration process on the Rewards Website and confirmed account activation to the potential Member.

If you wish to terminate your Membership, please email our customer service team at customer.service@paizo.com. Once your membership and Account is terminated, it cannot be reinstated, and all Gold in the Account will become void, of no value, and ineligible for redemption of any kind. Once your account is terminated, you will not be able to redeem any unused Gold or Rewards, retrieve previously-awarded Gold, Rewards, or Membership Tier status, request order history associated with the terminated Account, or obtain Gold for any future purchases or Rewards Activities taken while not a member of the Loyalty Program, even if you re-join in the future. Any new account you open with the Loyalty Program will start anew.

5.       MEMBERSHIP TIERS:

Paizo may establish different tiers of membership (“Membership Tiers” or “Tiers”) at its discretion. Each Membership Tier may be entitled to obtain Gold or Rewards, receive offers or promotions, or otherwise be subject to different terms from those available to other Tiers. Initial Membership Tier admission is based on money spent by a Member on their Account (“Member Spend”) during the 12-month period prior to creation of their Account or the Effective Date, whichever is later. The exact date your Membership Tier becomes effective is determined by Paizo. The 12-month period following the effective date of your Membership Tier is known as your “Tier Period,” and Member Spend during this time determines whether you drop, stay put, or advance in Membership Tiers.

The current Membership Tiers are as follows:

• Expert Tier: Accounts that have spent less than $250 USD during the Tier Period.
• Master Tier: Accounts that have spent at least $250 USD but less than $750 USD during the Tier Period.
• Legendary Tier: Accounts that have spent $750 USD or more during the Tier Period.

Once you achieve a new Membership Tier status, you will be notified of your new status and enter a new 12-month Tier Period. You will not drop from that Membership Tier during that Tier Period. But if your Member Spend during the Tier Period is no longer sufficient to maintain membership in that Membership Tier, you will be dropped to the appropriate lower Membership Tier at the conclusion of that Tier period.

• Ex: You have been in the Master Tier for 12 months and spent only $150. The Tier Period ends after those 12 months, and you are assigned to the lower Expert Tier because your Member Spend during your Tier Period was only $150 rather than the $250-$750 required to qualify for the Master Tier. You will be notified that you are dropping down to the Expert Tier and will enter a new 12-month Tier Period.

However, if you maintain your Member Spend within the required parameters of your Membership Tier during the Tier Period, then you will remain in that same Tier for the following Tier Period.

• Ex: You have been in the Master Tier for 12 months and spent $500. The Tier Period ends after those 12 months, and you remain in the Master Tier because your Member Spend was within the $250-750 range required for the Master Tier. You will be notified that you are re-qualifying for the Master Tier and will enter a new 12-month Tier Period.

On the other hand, if your Member Spend meets or exceeds the threshold for a higher Membership Tier at any time, you will be immediately placed into that higher Membership Tier (as soon as all qualifying purchases and Member Spend information is fully processed) and immediately afterward enter a new 12-month Tier Period.

• Ex: You have been in the Master Tier for just 3 months and have already spent $750. Once your qualifying purchases are fully processed, and without waiting for the end of your current Tier Period, you are immediately assigned to the higher Legendary Tier because your Member Spend met or exceeded the $750 threshold required to qualify for the Legendary Tier. You will be notified that you are advancing to the Legendary Tier and will enter a new 12-month Tier Period.

The total accumulated amount spent over the lifetime of your account does not affect the Tier to which you are assigned. It is based on Member Spend during the 12-month Tier Period that begins running after the effective date of your current Membership Tier as described above. Likewise, each time you move to a new Tier, the 12-month period starts anew. Any remaining time on previous Tier Periods does not carry over, extend, shorten, or otherwise affect any other Tier Period.

Membership Tier admission requirements are at the sole discretion of Paizo, and Paizo may modify, amend, change, suspend or terminate any or all Membership Tiers at any time, for any reason, with or without notice. There are no refunds for Membership, even if the benefits are not utilized.

6.       HOW TO OBTAIN GOLD:

Membership in the Loyalty Program allows Members to obtain membership rewards points (“Gold”) in the manner described herein. Gold may be earned subject to specific offers and promotions made by Paizo (“Offers”) and may be redeemed by the Member as described herein. Members may obtain Gold in any manner specified by Paizo in an Offer on the Rewards Website or on any other website maintained by Paizo or its affiliated companies, in social media or other media published by Paizo or its affiliated companies, and on or in packages, toys, books, and other products sold by Paizo or its affiliated companies. Ways to obtain Gold are specified by Paizo in each Offer, which Offer may be subject to time limitations or other restrictions, and Offers may include, but are not limited to, making purchases of qualifying Participating Products (as defined below) or participation in Rewards Program activities, referrals, product reviews, social media posts, or the use of in-box redemption codes (the “Rewards Activities”). The amount of Gold obtained for a purchase or Rewards Activity may vary by the Membership Tier applicable to the Member.

Currently, Members will obtain 25 Gold in connection with their initial sign up to the Loyalty Program and will accrue Gold in accordance with their Tier in the following manner:.

* Verified purchases only. Maximum of 5 gold per week per Account.

The ways to obtain Gold and the amount awarded for each Rewards Activity or purchase are subject to availability and subject to change, in Paizo’s sole discretion, with or without notice.

“Participating Products” are defined as genuine Paizo products which are the subject of a special Offer or promotion by Paizo or one of its affiliated companies, subject to the limitations and restrictions of such Offer or promotion, but only for the duration of such Offer or promotion. Not all Participating Products may be available in all areas. Offers and promotions regarding Participating Products are subject to change at the sole discretion of Paizo or its affiliated companies, at any time, with or without notice.

To obtain Gold by purchasing Participating Products on the Rewards Website, sign in to your Account on the Rewards Website and follow the online instructions. To earn Gold for the purchase of a Participating Product, you must be logged into your Account prior to purchasing a Participating Product. It is your responsibility to confirm that you are signed in to your Account before making any qualifying purchase. Gold cannot be earned retroactively for prior purchases that have already been shipped or purchased without being signed into your Account.

To obtain Gold, the purchase must meet all requirements and limitations of the Offer. No Gold may be obtained for the portions of any purchase which includes discount codes, tax, shipping, and other fees. Gold earned for pre-orders will be pending until your order ships. Please allow up to ten (10) business days after a qualifying purchase has shipped for your Loyalty Program account to update to reflect the Gold you obtained from the purchase. You can monitor your Gold total and see your tier status in your Paizo Plus dashboard. If you cancel, return, or dispute an order for a refund, your accumulated Gold will be reduced in proportion to the Gold originally earned for that purchase. In the case of a multi-item purchase which results in a partial return, the accumulated Gold in your account will be reduced in proportion to the Gold originally earned for the returned item(s). If the item is exchanged or store credit given because of damage, the Gold earned will remain.  

To obtain Gold by participating in a Rewards Activity, you must meet all requirements and limitations of the associated Offer. Specific Offers for earning Gold through a Rewards Activity may have detailed instructions given by Paizo or an approved Paizo-affiliated company, may require you to engage in certain actions while logged into your Account, may only apply to certain Members or during certain times, or may have other terms, conditions, or limitations that can vary per Offer. It is your responsibility to follow all instructions contained in an Offer in order to qualify for obtaining Gold. Any actions taken by a Member on third-party social media websites or applications must comply with the applicable Terms of Use for that website or application.

7.       GOLD EXPIRATION, TERMINATION AND FORFEITURE:

Unless otherwise provided in these Terms and Conditions hereafter, or in the terms and conditions of a future rewards program conducted by Paizo, or as otherwise provided by Paizo hereafter in writing, any or all Gold accumulated within this Rewards Program is, in Paizo’s sole discretion, subject to expiration, termination, and/or forfeiture in the following instances, and will be void, of no value, and ineligible for redemption of any kind:

• Upon termination of the Member’s Account by the Member or by Paizo for any reason;
• When Paizo determines, in its sole discretion, that Gold was improperly credited, obtained fraudulently, or otherwise is in violation of these Terms and Conditions;
• When Paizo determines, in its sole discretion, that the Member or Member’s Account has (i) violated these Terms and Conditions, the Terms of Use, or any other applicable Paizo policies, (ii) that the Member, whether acting alone or in concert with others, has violated or encouraged others to violate these Terms and Conditions or has otherwise attempted to commit fraud or undermine the Rewards Program, or (iii) that the Member or Member’s account has violated any applicable laws or regulations;
• Upon the expiration or termination of this Rewards Program; or
• Upon expiration of the Gold after one year of non-use.

8.       GOLD RESTRICTIONS:

Gold cannot be combined with any other points, credits, or other offers or promotions outside of the Rewards Program, and cannot be combined with the Gold of any other Member. Each Member is solely responsible for ensuring that their Gold is properly credited. Gold does not constitute property, does not entitle Members to a vested right or interest, and has no cash value. As such, Gold is not redeemable for cash and is not saleable, transferable, or assignable for any reason. Gold obtained may not be sold, traded, bartered, auctioned, donated, given away, or offered or awarded as a prize for any reason by a Member or any other person or entity other than Paizo or one of its affiliated companies. Paizo’s internal records regarding total Gold will be the official determination of a Member’s Gold total at any given time.  

9.       HOW TO REDEEM GOLD FOR REWARDS:

As part of the Rewards Program, Members may redeem their Gold on the Rewards Website for various products, discounts, and other items offered as rewards on the Rewards Website, or may choose to redeem Gold in order to participate in certain promotions and special offers where redemption of Gold is offered as a means of participating (collectively, “Rewards”), provided that they have enough Gold to redeem for a particular Reward. The Rewards Website will describe the amount of Gold (or a combination of Gold and cash) required to redeem each Reward. The Gold required for redemption of each Reward is subject to change at any time in Paizo’s sole discretion. You cannot redeem Gold for a Reward unless you have accumulated the required corresponding amount of Gold in your Account. 

To redeem Gold for a Reward, you must be signed into your Account at the time of redemption.  In some instances, Gold can be redeemed at checkout for a specific coupon code as the Reward you have selected, such as in the form of a discount on your purchase, free or discounted shipping, or additional product. Once you get to the checkout screen, you will see your total available Gold. To use your Gold, select the eligible Reward you want and follow the online instructions to complete your request for the Reward. Please note that if you do not have enough Gold for the Reward, you will not be able to redeem it. The shopping cart feature is designed to automatically deduct the value of any Rewards coupon from the order. Gold is not considered redeemed until the order is successfully processed. Once your order has been processed, the required amount of Gold for the selected Reward will be deducted from your Account. Rewards cannot be redeemed or added to an order retroactively.

If not used, Gold expires 365 days after being obtained, and the Gold with the earliest expiry is prioritized for Rewards redemption. All Gold must be redeemed within twelve (12) months, by the expiration or earlier termination of this Rewards Program, or by the termination of your Account, whichever occurs first.  See Section 7 (Gold Expiration, Termination, and Forfeiture) for instances in which Gold may be subject to expiration, termination, or forfeiture. Once Gold has expired, been terminated, or has been forfeited, it is void, of no value, and ineligible for redemption of any kind.

Unlike standard promotional items that are available to all Members, Legendary Loot Exclusive Rewards (“Exclusives”) are available only to Legendary Tier Members. Exclusives are limited in quantity and only available while supplies last. Paizo does not guarantee the availability of any Rewards or Exclusives for any period of time. Exclusives will be redeemed on a “first come, first served” basis based on when each order for an Exclusive on the Rewards Website is received and recorded by Paizo. Once an Exclusive is no longer available, that Exclusive will no longer be offered, unless otherwise determined by Paizo in its sole discretion. Exclusives are additionally subject to the same terms and conditions as all other Rewards.

A product, including Exclusives, redeemed by Gold cannot be replaced, returned, or refunded. Coupon codes and Rewards are intended for the sole use of the Member and cannot be transferred to another party. All Rewards available on the Website are subject to change or removal without notice. Rewards may be available in limited numbers and are only available while supplies last. Paizo does not guarantee the availability of any Reward for any period of time. Rewards will be redeemed on a "first come, first served" basis based on when each order for a Reward on the Rewards Website is received and recorded by Paizo. Once any Reward is no longer available, that Reward will no longer be offered, unless otherwise determined by Paizo in its sole discretion. No exchanges, returns, or refunds on a Reward are permitted for any reason. Paizo may, at any time and in its sole discretion, add new Rewards for redemption or remove Rewards. If any Reward becomes unavailable, Paizo reserves the right to substitute an item of equal or greater value in its sole discretion. Rewards are offered “as is” with no warranty or guarantee either expressed or implied by Paizo. Rewards may be subject to the manufacturer’s standard written warranty. Taxes and duties on any Rewards redeemed, if any, are solely the responsibility of the Member receiving the Reward.

The manner of shipping and delivery of Rewards is at the sole discretion of Paizo. All Rewards will ship to the address associated with your Account. No shipping is allowed to other addresses or to P.O. boxes. Paizo reserves the right to require you to complete, sign, and return an affidavit of eligibility and liability and publicity release in order for you to claim a Reward.  In the event of non-compliance, Paizo may, in its sole discretion, deem you ineligible to receive the Reward. No responsibility is assumed by Paizo for any Reward after it has been shipped or in the event it is returned as undeliverable without a forwarding address.

10.     MEMBER COMMUNICATION & PRIVACY POLICY:

By becoming a Member of the Rewards Program, you agree to receive email communications about the Rewards Program, as well as product marketing material from Paizo. Members may unsubscribe or change newsletter communication preferences at any time via the link in a Paizo email. Please note if you unsubscribe from all Paizo notifications, you may no longer receive email updates about Rewards Program benefits, Tier status, or new Rewards. All personal information collected in conjunction with the Rewards Program will be collected and used in accordance with the Privacy Policy.  

11.     GENERAL CONDITIONS:

Paizo and its affiliated companies (collectively the “Released Parties”) are not responsible for illegible, lost, late, damaged, incomplete, misdirected, unintelligible, returned, undelivered, or postage-due mail, receipts, Gold, emails, text messages or for lost, interrupted, or unavailable satellite, network, server, Internet Service Provider (ISP), Rewards Website, or other connections availability, accessibility or traffic congestion, miscommunications, failed computer, network, telephone, satellite or cable hardware or software or lines, or technical failure, or jumbled, scrambled, delayed, or misdirected transmissions, computer hardware or software malfunctions, failures or difficulties, or other errors of any kind whether human, mechanical, electronic, or network. Persons who tamper with or abuse any aspect of the Rewards Program or Rewards Website, or act in violation of these Terms and Conditions, or act in any manner to threaten or abuse or harass any person, or violate the Terms of Use, as solely determined by Paizo, will be deemed ineligible to participate in the Rewards Program and may have their Account terminated by Paizo in its sole discretion. Released Parties are not responsible for any incorrect or inaccurate information whether caused by users, tampering, hacking, or by any of the programming or equipment associated with or used in the Rewards Program or on the Rewards Website, and assume no responsibility for any errors, omission, deletion, interruption, or delay in operation or transmission or communication line failure, theft, or destruction or unauthorized Rewards Website access. Any use of robotic, macro, automatic, programmed methods of making purchases, engaging in Rewards Activities, or obtaining Gold will void all such related Gold, and may subject the Member to termination of their Account. Released Parties are not responsible for injury or damage to Members’ or any other person’s computer or property related to or resulting from participating in the Rewards Program. Should any portion of the Rewards Program be, in Paizo’s sole opinion, compromised by virus, worms, bugs, unauthorized human intervention, or other causes which may corrupt or impair administration, security, fairness, or proper play of the Rewards Program, or submission Activities or Gold, or the redemption of Rewards, then Paizo reserves the right at its sole discretion to suspend, modify, or terminate the Rewards Program, and determine and resolve any issues related to submission of Gold, or the redemption of Rewards, in its sole discretion. The decisions of the Paizo are final in all aspects of the Rewards Program.  

This Rewards Program is void where prohibited by law and is subject to federal, state, and local regulations.

These Terms and Conditions shall be governed by the laws of the State of Washington, without regard to the conflict of laws provisions of such state or any other state.

12.     DISPUTE RESOLUTION:

Unless prohibited by law, by participating in the Rewards Program you agree that: (a) any and all disputes, claims, and causes of action arising out of or connected with your Rewards Program membership or participation in the Rewards Program, or any Offer or Reward within the Rewards Program, or any of these Terms and Conditions, shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate federal or state courts located in King County, Washington; (b) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in the Rewards Program, but in no event attorneys’ fees; (c) under no circumstances will you be permitted to obtain awards for, and you hereby waive all rights to claim, indirect, punitive, incidental and consequential damages, and any other damages, and any and all rights to have damages multiplied or otherwise increased, other than for actual out-of-pocket expenses; and (d) monetary damages are adequate to compensate you for any damages you sustained, and therefore you shall not be entitled to equitable or injunctive relief relative to the Rewards Program. All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms and Conditions, or the rights and obligations of any Member or participant and Paizo in connection with the Rewards Program, shall be governed by, and construed in accordance with, the laws of the State of Washington without giving effect to any choice of law or conflict of law rules (whether of the State of Washington or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Washington. DO NOT BECOME A MEMBER OF THE REWARDS PROGRAM OR PARTICIPATE IN THE REWARDS PROGRAM IF YOU DO NOT AGREE TO THE FOREGOING DISPUTE RESOLUTION PROVISIONS. BY BECOMING A MEMBER OF THE REWARDS PROGRAM OR PARTICIPATING IN THE REWARDS PROGRAM, YOU AGREE TO THE ENTIRETY OF THE ABOVE TERMS AND CONDITIONS.
