Move Action & Five Foot Step

This came up in a game but we let the GM make a quick ruling to move on, the situation is as follows: my character had broken out of prison and was weaponless, his rescuer had a weapon. Emerging from the prison into the courtyard he noticed a greatsword next to his rescuer. I was controlling the rescuer and asked if I could toss the weapon and then 5ft step towards a guard (move action + ?? action) and then attack the guard (standard action). The GM ruled no because he said you couldn't move and make a 5ft step although I thought one could do a move action that wasn't moving and make a 5ft step, thus allowing him to attack. My question is who was right and also what the rules around 5ft steps are (also if picking up a weapon and passing it is a move action). If you would give a page number or tell me where I can find the answer it would be greatly appreciated so that I can show the GM either way. Thanks in advance!

I believe you can make a move-equivalent action and a 5 foot step, provided you haven't already moved in the round.

Picking up an unattended item falls under manipulating an object, which is a move action....but does not involve actual movement.

Throwing it with the intent of you catching it would have to be a standard action, however. If he just dropped it into an adjacent square, it would be a free action.

Once the weapon is thrown, he is free to 5' step to get adjacent to the guard.

If, instead of throwing it, he dropped it, he could 5' step and attack.

The rules with movement and the 5' step applies because if you 5' step and then move then you didn't really 5' step you just had continued movement. Other than that you can move equivalent actions and still 5' step in a round.

Rules from the SRD
You can move 5 feet in any round when you don't perform any other kind of movement. Taking this 5-foot step never provokes an attack of opportunity. You can't take more than one 5-foot step in a round, and you can't take a 5-foot step in the same round that you move any distance.

You can take a 5-foot step before, during, or after your other actions in the round.

You can only take a 5-foot-step if your movement isn't hampered by difficult terrain or darkness. Any creature with a speed of 5 feet or less can't take a 5-foot step, since moving even 5 feet requires a move action for such a slow creature.

You may not take a 5-foot step using a form of movement for which you do not have a listed speed.

Notice how it says in the first paragraph "Movement" and not move action, thats because there is a difference. Your DM was mistaken when it comes to the 5' step + move equivalent action ruling
