Silver Crusade

* Looks at everyone. *

Look, it's just nice to just attribute people in the front page as well as the OGL section 15. Someone may honestly think you are committing fraud and will go after you if you don't cite them and/or give them credit.

As someone who is just finishing his first piece of hopefully soon to be published work, my thanks for all of the advice in this thread.

This look at the various legality's and also the open and frank way that many publishers choose to be helpful simply reaffirm to me the fact that the pathfinder TPP community is excellent.

Yet again, my thanks.

It does matter if it's true or not! We shouldn't mindlessly pass along falsehoods without checking them, and we shouldn't encourage copyright holders to engage in unnecessary legal action, or discourage them from protecting their rights when they're justified to and legally empowered to.

Legally, the OGL protects you from claims of misuse of their material if you follow its terms. No one has any justification for throwing around claims of fraud if you've used material under the OGL by the rules. Section 7, on the use of product identity, seems to forbid credit on the front page; if you want such credit, I think you should explicitly give a license to use the name of the product in such a way.

I agree. I meant the truth or otherwise doesnt matter to what I said. Given that widespread belief (which you think is false) I dont think one should necessarily take the revealed pm as being intimidatory - that was my point.

I took it as a warning "Hey - get this stuff right, it matters" not "I'm out to get you" (whose got time for that?)

As for mindlessly passing on falsehoods and encouraging or discouraging anything - I'm not doing that. I was genuine when I said "I dont know if you're right or wrong". It wasnt code for "I think you're wrong".

Of course it might be better for a publisher to say to the other person, "For our product, do it like X and I promise that we won't hold you in violation. Someone else might, but as long as you cite our material in that fashion, you'll be fine with us." Instead of playing some kind of guessing game. "Go ahead and try to do it right, but if it isn't 100% perfect in our view, we'll take you to court. Skip Cease-and-Desist letter, go straight to court, give us $200."

I will say that the reveal of any PMs in no way effects my view of any people posting in this thread, nor my desire to purchase any of their products.

One of the nice things about the OGL is that it has remedy for breach built into it.
13. Termination: This License will terminate automatically if You fail to comply with all terms herein and fail to cure such breach within 30 days of becoming aware of the breach. All sublicenses shall survive the termination of this License.

So does the Pathfinder compatibility License.
7. Breach and Cure
If you fail to comply with any of the terms of this License, you will be in breach and we will have the right to terminate this License. We will send notice to the contact information you provided in your registration. You will have thirty days from the date we send notice to cure the breach to our satisfaction. If the breach has not been fully and completely cured, we reserve the right to terminate the License with no further notice. After termination, you will not have the right to secure a new license from us without specific written consent.

So even if you get it wrong, if someone bring that error to your attention the license (if the OGL, they are also bound to if they released material under it) you get 30 days to fix it. Paizo similarly gives you a cure period for the compatibility license.

FYI

Dear Mr. Develyn,

Thank you for your recent email. Unfortunately we do not provide legal advice or explanation in general. If you require help interpreting the OGL in a legal context, you need to seek your own legal counsel. I’m sorry I can’t help.

Kind regards,

Veronika Friedrich

Dear Sirs,

I hope you don't mind me writing to you about this, as I know you've

moved on a little bit with regards to game systems and gaming licences,

but I wonder whether you could possibly clarify for me one question

regarding point (10) where you state:

10. Copy of this License: You MUST include a copy of this License with

every copy of the Open Game Content You Distribute.

If I distribute a product in electronic form only and as a collection of

files (e.g. PDFs) inside a master file such as a zip file, is it

acceptable for the copy of the licence to exist solely within one of the

files in that collection?

For example, if I write an OGL compliant adventure with code name

"4$d1.1" and name "The Firemaker", could I distribute that by means of a

single zip file called "4$d1.1.zip" which would contain (at least) these

two files: "4$d1.1 The Firemaker.pdf" and "4$d1.1 Open Game Licence

1.0a.pdf", where the OGL text would only exist in the second of the two

files.

Thank you for your time

Yours Faithfully

Richard Develyn

With all due respect ... doesn't this confirm what pretty much everyone in this thread has said to you from the beginning ...

I don't think that, actually, though I'm sure there'll be people who do.

But that's ok, though, isn't it. I mean, it would be a very boring world if everyone agreed all the time.

With all due respect.

I just posted up the reply from WotC because I thought the readers of this forum would be interested - whatever their point of view.

Richard

I'm interested that they responded so rapidly. I presumed they'd ignore you, although I guess they don't want to be seen to be condoning anything through inaction.

While I think you'll likely get the same response, I'd email the US division as the international divisions are likely nothing more than an office with a handful of people.

The license is granted by a US company, and that's where the vast majority of staff resides.

Dark Archive

It can't do any harm, can it.

I thought it was a bit of a non-response, myself. Sounds like they're not that interested.

Even though it's not what I'm planning to do anymore (the OGL is now 2 pages of a 36 page product), I might see what the US division has to say about it.

Why is it like that when you can use small font. hell green ronin and paizo usually get the OGL down to a half a page. I have always been able to get it on a page, and that's including 1001 spells.

Dark Archive

I suppose I could shrink the font some more. I'm a bit worried about shrinking it too much in case I end up having to see a lawyer :-)

This is still what I'm working from:

http://www.qusheet.com/misc/Pathfinder%20OGL.pdf

Richard

Yeah its all copy pasteable so if someone needs to make it fullsize they can on thier own. I would get rid of the spacing after anything (looks like you have spacing after the end of every line, and make the font as small as you need to get to one page.

And thus, microdot technology was revived to help ensure OGL compliance within limited layout space.
