That's the main problem. Who wants to spend the first 3 rounds of an encounter doing nothing but getting ready to fight? Without swift action spells or long duration spells that can be up all day (not too many of these that are OGL) the first half of the encounter is going to be very boring.

Clerics. :P

Anyway, you often have an inkling that combat is imminent. The 3 rounds need not be during the encounter.
