And yet, they can still -with ease, if it's a focus of their build-make that DC 39 Acrobatics check to go around it, at those higher levels. Which should be more then enough for most purposes, and enough to achieve whatever flanking or teamwork combinations they might be going for...

It's really not a nerf. Not to the overall game, and only to a clearly imbalanced check to begin with. And oh dear, the poor poor rogue can no longer easily do something that would be inherently suicidal to any rational being... ;) Instead, he can quasi-realistically-not-actually-realistically-but-still-believably-within- the-realm cartwheel to the side of a dragon and get...oh wait, really the same mechanical benefits (Flanking, etc. Ad Nauseum).

Frivolous complaint, anyone? If it really is a large nerf, then, well, considering the lack of general outcry, it's not an important one.

He do plenty of suicial things with ease. He can fall from the stratosphere and survive the 20d6 fall with no problem. What he can't do, is what Samwise does here around 2:04 mark.
