Does using a wand on a prone ally provoke?

Situation: Oracle is uses a wand of Cure Light Wounds on a prone ally in an adjacent square.

Question: Does the enemy in an adjacent square get an attack of opportunity as the Oracle bends over their fallen ally to apply a touch spell from a wand?

It clearly states in RAW:

But does the fact you have to apply it to a prone ally change that?

I question this also, activating the happy stick doesnt, but the action of using it on a prone ally as you need to touch them with the wand in a threatened square should as you are (a) highly unlikely you have a weapon in hand and if you do, you arent able to use it effectively as (b) your attention is on the fallen ally not the foe, and (c) you are probably bending or kneeling down with eyes averted to touch the ally then activate the wand in the first place.


One could certainly houserule it, but RAW using a touch spell doesn't provoke other than during the casting. Since using a wand means no casting, no provoke. Activating a wand is specifically called out as non-provoking.
