what, prismatic ray and wildstrike? They're going to sue if paizo makes a spell with the same name? Suppose paizo made a critter called 'mindflayer' that's just a giant tentacle monster with brains on the tips of its tentacles and doesn't resemble wotc's mindflayer at all.. is that still a problem?

Wildstrike may be, but the prismatic sphere/wall/spray spells are in the SRD, so are Open Content. Anyone can use them for free.
Edit: Noticed you sad Prismatic RAY. That one isn't open content. But its just a Prismatic Spray spell that only targets one person. Call it Prismatic Beam, and its fine.
And yes, they can sue if Paizo uses non-open content. If they change it so its different enough, though, its fine. But making a spell with the exact same mechanics and name as a non-open content spell is grounds for legal action. Doesn't mean WotC will use legal action, but they have the option to do so. Same with the monster.
