Damage penalties?

Under the combat chapter, a rule states:

Minimum Damage: If penalties reduce the damage result to less than 1, a hit still deals 1 point of nonlethal damage.

Are things like energy absorption, DR, improved evasion successful saves considered penalties? Or is it only referring to if you have a strength penalty? Also, do spells that use a touch attack benefit from this, as they require an attack roll to hit.

Energy absorption, DR, improved evasion, etc. are not penalties. Thise are effects or abilities that reduce or negate damage entirely.

The 1 point non-lethal damage rule generally applies to physical attacks such as weapons.

Can you be more exact as to the touch attack you have in mind?


Well, if it only applies to penalties, then damage from touch attack spells won't really matter, as I can't think of anything that says it gives a penalty to spell damage. It was only in the case that it applied to things like DR or energy absorption.

The only thing i can think of is the 3.5 warmage, and edge. If by some odd reason you had a warmage with a -int (say from int drain) then the minimum damage on the spell would still be one. So a level 1 warmage who has been hit with int drain and is at say 6 int, casts burning hands, thats 1d4-2. If he rolls a 1 or 2 the spell still does 1 damage. (though this could still be negated by energy resistance, or a host of other abilities). Though its possible the warmage edge has specific text to avoid this, I am not sure as i dont have the book in front of me.
