Ninja isn't open content - Wizards doesn't let anyone else play with it (unless the Dragon version is usable).
Maybe Rokugan d20's ninja would be usable?
The ninja IS open content, the Complete Adventurer basic class isn't. WotC would have to have major gonads (and little brain) to try and say that the ninja is their intellectual property.

I know that the concept of the ninja isn't protected by Wizards, but the question remains which class you're going to use if not the CADv version. I know of the Legend version, but can't think of any other.

The could always create their own. The CAdv one kind of sucks anyway.
Personally I find it non-multiclass friendly and I'm not a big fan of the 'let's try and get everyone to stick to one class for 20 levels' mentality that happened in the Completes, Magic of Incarnum, Tome of Magic, etc.
That's why d20 modern ruled.

So is the Artificer open content? While hardly my first choice, it would be an interesting #12.
And there are all those 3rd party OGL base classes, or the ones in the Dragon Compendium... Yikes.
Artificer is closed content... and broken. I wouldn't want one on our cover, cause they cheat. This has nothing to do with my character in Jason Bulmahn's Eberron game getting killed by a cheater artificer, though. It's perfectly okay for a 7th level artificer to be able to create what amounts to a 9th level spell and a 5th level spell all in one round, yeah?
Grrr.
The ones in the Dragon Compendium are closed content too; we can't use them either.
We can use the classes from expanded Psionics Handbook, or any of the NPC classes in the DMG, or the prestige classes in the DMG, or the base classes from Green Ronin's books (we've already had a thaumaturge from Book of Fiends, for example)... so there's plenty to choose from.

I vote for a rake/noble/swashbuckler kind of class, or a mix of all that.
A class for sons of noble houses with an adventurous streak:
D8 or d6, medium to strong BAB, strong reflex, maybe strong will, too. 4+ or 6+ skill points, mostly social skills (diplomacy, bluff, intimidate, gather information, sense motive) paired with knowledge and the like (to reflect the noble education) and a little bit of acrobatics thrown in.
For class abilities, he'll have some stuff to help a flashy combat style with rapiers and the like as well as something to reflect his influence and money.
Should be perfect for the second adventure path, or for Pathfinder in general, where I'm sure more than a few young nobles do more than sit on their arses playing a nobby form of Harrow and sipping expensive wines.

I vote for a rake/noble/swashbuckler kind of class, or a mix of all that.
I use a modified Bard for a 'PC Aristocrat' or Noble. Change all references to music to 'inspiring oratory / battlefield tactics,' change the spontaneous spellcasting to prepared spellcasting (fewer spells / day, but can have spellbooks full of 'em), tweak the spell-list to have a few less sonic / music themed spells, and bang, light fighter / educated noble diletante with the ability to 'rally the troops' via inspiring speeches. Same hit points, armor, weapons, skills, saves, etc.
