I like to play rogues. Rogues, that is, not thieves. They're adventurers, not criminals. They use their talents to help the party succeed, just as the other party members do, not to prey on innocents. So, why do I have to go to out-of-the way shops to purchase a new set of tools? Why am I the one that gets funny looks when something turns up missing (because, it turns out, the freakin' mage misplaced it). Every class has talents which could be used for good or bad, so why am I the usual suspect? Are every warrior's tools-of-the-trade(i.e. their weapons) considered 'assasin's' tools? No? Then why are every rogue's tools-of-the-trade considered 'thieves'' tools?

I feel your pain. I endured the same effect when i played a rogue in my first D&D campaign. I didn't want to be a theif, but everyone kept labeling me as that. Even more frustrating was the label of the thief-acrobat PrC and the prereqs in Song and Silence. I just wanted to be a dexterous, mobile fighter, not a thief.
For the most part, the label "thief" is more of a holdover. Theive's tools can just be relabled as lockpicks, which aren't contraban or anything. Just put a few ranks in profession locksmith. :)

But by being a dextrous mobile fighter you are a thief. You are theiving good fight time from the fighters! ;-)

Rogue and Thief aren't that different from each other as words go. Adventurer's tools might be what you are after. Though breaking and entering (what theives tools are used for) smacks of thieving to me. Most adventurers are thieves (even the fighters and wizards). They break into tombs/outposts/temples/etc. and steal stuff...and usually kill everyone there too. Damn thieves.

I currently play a Rogue/fighter who has maxed out the skill Profession:Locksmith. He is a dwarf who is not sneaky, or very dexterous(13) but he makes a good living by making locks, manacles, door knobs, etc. and by opening jammed locks, and troubleshooting other security issues. He is Neutral/Good and a fine, upstanding citizen. It is all in how you play the class. I have Masterwork LOCKSMITH tools, which cover all the standard thieves tools items, and I have maxed out Disable Device and Open Locks, as a Locksmith should know the inner workings of a lock with or without traps. Play it as a person with a profession and be extremely offended when someone suggests that you did something as vulger as "Theiving".

BTW... anyone who calls you a thief should be handled this way:
1. Quickdraw your greatsword (rogue5/fighter4)
2. You will win initiative so sneak attack him/her for 2d6+str mod +(3d6 sneak attack).
3. Show them why you multiclassed as a rogue/fighter by beating the tar out of 'em!
4. Get the party cleric to "speak with dead" and ask if they still think you are a "thief".

It's just the way things work pal. Doesn't matter what your character uses them for if I rummage through a backpack and find a bunch of lockpicks, drill bits, wire cutters ect. I'm going to think thief. They are thieves tools because of what people commonly assosiate them with and there is not a lot you can do to change it, except maybe FH's A-class beat down suggestion.
You are what you own I'm afraid. For instance, strap a symbol of Pelor to your breastplate and count how many more beggers are visiting you in the street. In all actuality You may be a murderer flaunting your latest trophy, but the people will assume whatever they want.
and guards in particular make a lot of assumptions... man its tough being a rogue

Tell you what, lets rename the class "legitemate businessmen," they can open doors and locks with "pillars of the community" tools, make "pragmatic endeavor" attacks, and "borrow from the unknowing on an indeterminate return schedule."

Rogue is just a more positive way to say thief, really. It's saying, "Yeah, I steal from the rich, but only to give to the poor. Admit it, I'm not a criminal, I'm a lovable scamp!"

Wait a minute...What about those sneaky Wizards and Sorcerers, with their invisibility and silence spells? All the spot and listen checks in the world won't help against the party wiz rifling through your stuff while you sleep.
And then they try to explain it away, saying "oh, the alarm spell I cast was bypassed!"
