i reread the sneak attack rules when one of my players mentioned sneak attacking with a great axe i thought immediately no way has to be a finesse weapon but upon reading sneak attack it doesn't stat that anywhere there's no reason he couldn't do it with a axe by raw from what i see. am i crazy or just missing something?

There is nothing restricting a rogue from doing a sneak attack with any weapon. Heck, you could sneak attack with an improvised weapon if you wished.
the only restriction on weapons is that you cannot make a non-lethal sneak attack with a lethal damage weapon.

Okay, you're not crazy, but you don't have to be a sneaky rat to be a rogue. You could play a half-orc enforcer who focuses on strength, wields a greataxe and is a nothing like a stealthy halfling. He'd still be a rogue with sneak attack. (And Martial Weapon Proficiency)
you totally just described the character my player is playing ha! so thats one of the changes form 3.5 that i missed then cool. pssh and people say rogue is weak heck sneak attack was buffed more ways from sunday. rogue on horseback with a lance just sayin >.>

There was nothing in the 3.5 that restricted it to finesse weapons either. I have seen a half-orc rogue/barbarian played before.
Also rogue/druid can be a great combo for a forested area. Who is going to notice the animal that passes by...

There is no (and never was that i recall) a rule against sneak attacking someone with a big honking sword. High strength orc rogues with axes and falchions are vogue for that reason.

Rogue + major magic talent + Chill Touch spell = fun!
If flanking it equals (1d6 neg energy damage + 1 str damage + sneak attack) each touch attack. And you can do it as many times as you have rogue levels per casting (and you can cast it twice a day).
The touch attack makes it much easier to hit and if you also take the crippling strike talent, you can drop their str by 3 per hit.
At level 10 with a full round attack this is:
(1d6+5d6)+3 str damage @ +7 melee touch attack
(1d6+5d6)+3 str damage @ +2 melee touch attack
Average of 42 damage and 4-6(depending on if they made their fort save) str damage per round for 5 rounds.
