Such a tough issue, since the material is copyrighted. I'm almost certain the article was also reprinted in Best of Dragon Volume 1. I just checked e-bay and someone is selling that magazine (Best of Dragon Volume I, II and V) for $6.99. My old "Best of Dragon" issues wore out long ago; main reason I bought the Dragon CD ROM archive when it first came out.
I would say go bid on those three issues (buy it now price is $9.99) and you'll get that article legally.
EDIT: I'm not sure if it was in volume I or volume II of the Best of Dragon, but both those issues are available fairly cheaply on e-bay. If you're playing old school AD&D, picking up those issues will be useful for more than just the critical hits tables, so you might really try to bid on both those issues.

You can find a copy in the Dragon Compendium, Vol 1. I'd definitely encourage the purchase of this excellent tome. It's worth it's price.

IIRC, in another post Rhyno was looking for the charts for old school AD&D. The new Dragon Compendium is awesome, but those charts were adapted for 3.5 and aren't nearly as detailed as the ones for AD&D were.
Best of Dragon Vol I or Vol II (from the mid 80's) had a reprint of the original article from Dragon #39.
