Item creation only cares if the required spell is at least a certain level, not that it's an exact level.
Is there a source on that? I'm not sure the rules actually specify if level is part of a spell and while that ruling passes the sniff test to me, I don't think that's exactly how crafting is worded.
Also, now that SoM is out, it looks to me that Magus' indeed can't use lower level spells on a staff, and barring rulings like the above, can't cast lower level spell scrolls/wands.
