Hi, I know this item have been discussed a lot as it already is, and I'm not trying to open up that big discussion again.
My first question is this:
If I create a headband of Vast intellect at 3 lvl, I would be able to choose its skill, will I then be allowed to choose flying as a skill?, (it says in the skill description for flying that you cant take ranks in it before you have the means of flight)
Second question:
If I create it with Linguistics, will I then be able to new languages each time I take off the headband and then wear it for 24 hours?

I would say that if the character creates it, they can choose what skill gets put into it, but I also think they have to have ranks in the skill, so this item is more for trade than anything else, I think.
If the skill is Linguistics, the languages would be set at creation time.
Use fly as the skill? Sure. You're not taking the ranks really, they're implanted on your memory.

With linguistics, I'd set it to always the same language.
With perform, for example, you cannot change the type, you shouldn't be able to do it with languages either. It feels wrong.

I beleive you would be stuck with the same langauge, the same way someone may be stuck with the same knowledge such as arcana or religion.
