Like you guys I was very dissapointed in the loss of Dungeon - especially since I had only been a subscriber for a little more than a year when it went away. Unlike some of you I like the adventure paths and Pathfinder suits my needs (different than Dungeon, but an equal value to me).
I believe that this situation was beyond Paizo's control (including the late notice) and, IMHO, the company has gone above and beyond to make sure you get the value for the money you paid - either the money back or a bonus to what you paid if you leave that money with them.
Paying a discounted rate for multi-year subscriptions and then wanting cover price back for undelivered issues is not so very reasonable (again IMHO). And, though I'm not a lawyer, I'm pretty sure no one is going to successfully sue anyone over this.
Dungeon and Dragon still exist and if you need what's in them you can get your check and sign up with WotC for them. I'm sure Paizo would appreciate your continued business - but I doubt they want it at the price of considerable drama and unreasonable individual demands.
