Is an apparatus considered a misc magic item or a monster?

Oh! Oh! I know! How about an apparatus that can be used to open doors and trigger traps and such. I'd like to no longer be subjected to untold torments every time I'm summoned.
We have to do something about these goblins!

Poofs into view on a nearby staircase. "WHO THE HELL SUMMONED ME HERE?! AAAAAGH!" falls down the stairs and poofs out of view as they hit the bottom.
