A 170 foot tree (about four feet wide) just fell over just shy of my house. A few feet to the left and it would have landed on the propane tank and a bit further it would have impacted with the roof. It went all the way up the hill to the next house up (I'm in the woods). No major property damage (a fence was destroyed) and no one hurt...

Last year some poor guy on my block had his house hit by three threes in the same storm.
Yeah, there's not a lot you can do when the tree's on someone else's land. The thing is, it was sagging and leaning bad after the wind storm last month. I was wondering when and where it was going to go down.
The tree was half dead for years and the owner was warned several times by neighbours and tree professionals it was coming down but they chose to cross their fingers. I'm still a little mad.

If its worth it for the amount of damage you had, the facts you describe would probably make your neighbor (and by extension his home owners insurance) responsible. It's the ignoring a known danger that gets him out of the act of god defense.
