I evil eye a target, then move 40 feet away from target. What happens.

Rules Questions

Ok, so I know you need to be within 30 feet of a target to inflict your evil eye upon it. However, if you or the target moves beyond that 30 foot range does it remain active?

Yes it remains.

Or else walking in the other direction from a witch grants Immunity.

yes

Why wouldn't it remain? The text measures the duration in rounds, not in distance from the witch.

The practical difficulty will be with drawing the effect out with cackle, but that's a separate issue.

If a spell or power doesn't mention that you need to stay within a certain range, then you don't need to. Take Shield Other fx.

Walking away 30ft does have the benefit of forcing the witch to move to cackle to extend duration. Even better, assuming 30ft movement for everyone involved, moving 35 ft means she can't cackle because she would need to double move, leaving no actions to cackle.

My DM thought you needed to stay within 30 feet to keep it working

That's why witches buy horses.

He was still wrong if he thought that was what the rulebooks say. Having the authority to ignore the rulebooks doesn't automatically make you right about their contents.
