I worked out a couple of rules, then I realized that something I've created for my villain may count as a new rule already... So, would a Special Ability like darkvision or constitution drain count as a new rule or its just part of the villain?

I'd say a new special ability counts as part of the villain and not a new rule, though that's just my take on it and nothing close to official.
Darkvision exists in the game. Adding it to a villain is not a New Rule.
Constitution drain exists in the game. Adding it to a villain is not a New Rule.
(Even if your villain's race does not normally have either of these abilities.)
Creating a New Rule requires you to put on your Designer Hat, not the Copy This Text From the SRD Hat. :)
So, given the limited info you've supplied, I think you're fine adding darkvision and Con drain to your villain, and the New Rule is something different.
In fact I ment a new special ability designed for the villain.
