I totally assumed that hit with the sword was a crit. Also, I thought they surrender if using deception, diplomacy, or intimidation with a 2 action check. Is this not the case with these guys?

The "surrender" only happens when they get the "shaken" condition. Unfortunately, since these guys are the 'rear guard', they won't surrender... you'd have to either knock them unconscious or well, terminate them

Anjo marks Green as prey and sends three arrows. The first two hit but only the second arrow appears to stick into the creature. His first arrow bounces off the creature's arm.
Green seems to stop and focus. Immediately, a cloud of blackness surrounds it. (Green is now concealed). Green then strides forward and swings at 1-Franzine 2-Emdi: 1d2 ⇒ 2 with its staff.

FYI, the total damage from each arrow of Hunted Shot are combined for the purposes of resistance and weakness. So if Green has DR10, it takes to full damage from the second arrow.
