If a character has a vow of silence that they derive bonuses from (and penalties if they break said vow), does telepathy count as speaking, meaning that using it breaks the vow?

Up to the GM's interpretation, I suppose, but I lean towards it counting as breaking the vow.
Really, though, the vow shouldn't be something where you focus on the exact wording of the vow, but to the intention behind the Vow. Since, after all, the Monk's Vow is a self imposed rule. Which, as a Lawful Character, is meaningful because they adhere to their self-imposed rules. This isn't the Paladin's code, there's no deity attached here, the Monk knows the intention of their Vows, knows when they are following their own rules, and when they break them.
It's the Player that should be managing Monk Vows. If the player can't role play a Lawful Character, perhaps because they don't understand the perspective, they really shouldn't be allowed to be taking Vows, and more so, probably shouldn't play lawful characters.
Honestly, sounds like an issue created from certain classes having required alignments.

It's not a vow of non communication. They can sign, and they can write, so I don't see why not. Is it totally working around the penalty the vow is supposed to impose? Absolutely,I won't deny that, but it's also a much harder way than just putting a point in linguistics for sign language or writing things down.
