Can I use a lesser rod of intensify with a empowered Fireball?

As the title says, I´m not sure if I could use the rod, as it is a level 3 spell, but cast in a level 5 slot (I´m a sorcerer)

In this case, since being a 5th level spell is more disadvantageous, it counts as a 5th level spell, and you couldn't use a lesser metamagic rod with it.
