Ok so my paladin had a legendart sword Glaumdryng. I took the ability twice. Which gives me size abilites. But in inky tier 3. So I can't activate more then 3 abilities.
Question is can I take itelligence. Then Take it say 3 more times. That's upgradeable, foe biter, then intelligent 4 times. Then have those 3 active though I spent 4 ppints in intelligen?

Me and my GM are confused by this.
Its like this, in Hero Lab I checkmark legendary Item, and then I choose three abilites, because at rank 3 you can USE 3 abilites at once.
BUT, it also lists that I get 6 total abilites, because you get double your rank when you take Legendary Item a 2nd time.
My question, worded better here maybe, is this.
If I take Foe Biting, Intelligent and Upgradable, those are my 3 I can use at the same time.
Then can I take Intelligent 3 more times, adding spells or abilites or whatever, and still have that count as 3 abilites in use at once?

I'm going to break it up into parts:
Legendary Item (Ex): You gain a legendary item. This item grants a number of abilities equal to your tier (maximum 3).So, if you take the ability once at tier 3, then you would get to choose 3 abilities for your item. If you took it at tier 1, you'd only get to choose one ability, but the intention seems clear that you would add abilities as you gain tiers up to the maximum of 3.
At 3rd tier, you can select this ability again, increasing the maximum to six abilities and causing the item to become a lesser artifact.This part is confusing. Although you can take the ability again as soon as tier 3, you would still be constrained to the tier limit of 3, which means despite taking Legendary Item a second time you still wouldn't gain any extra abilities from it. This may be a possibility because of the feat Mythic Paragon which lets you count your tier as 2 levels higher. So, a 3rd tier mythic with Mythic Paragon who has taken Legendary Item twice would have an item with 5 abilities. If you don't plan to take Mythic Paragon, then there is no point in taking this a second time until you are at least 4th tier.
At 6th tier, you can select this ability again, increasing the maximum to 10 abilities; the item then becomes a greater artifact.
The third time has the same issue as the second time. There is no point in taking this at tier 6 unless you also have Mythic Paragon.

Just to clarify, while you can select up to 6 abilities, only the first 3 will be active.
Each instance of "Intelligent" counts as an ability in and of its own.
This means that, you could have Foe-bitter, Intelligent and Upgradable active at tier 3, and then each tier, you would unlock another "Intelligent" unless, as mentioned by Melkiador previously, you take Mythic Paragon.
As a side note, there's one major reason why you would want to take Legendary Item at tier 3 or 6: To push it to minor or major artifact.
That means that taking Legendary Item at tier 3 would allow you to have Foe-bitter, as it specifies the items needs to be a minor or major artifact.
