1. No. A scroll of animate dead is not evil, thus, I would conclude that this particular magical item, which includes this spell, is also not evil.
2. No. Golems are constructs. I would liken this to considering whether or not an animated table or broom are considered evil.
Now the catch here is that the construct is not made out of typical artisan materials, such as clay, metal, wood, stone, glass, etc. It is made of flesh from deceased people, ala Frankenstein's monster. This makes the creation of this golem creepy, eerie, and not in good taste. But I would not call it an evil act.

I believe the creation of a flesh golem is considered an evil act. It certainly requires the creator to cast an Evil spell (Animate Dead). The golem entry describes creation with the following passage:
Flesh Golem Construction
The pieces of a flesh golem must come from normal humanoid corpses that have not decayed significantly. Assembly requires a minimum of six different bodies—one for each limb, the torso (including head), and the brain. In some cases, more bodies may be necessary. Special unguents and bindings worth 500 gp are also required. Note that creating a flesh golem requires casting a spell with the evil descriptor.

I'd say even though the spell is "evil" it depends on where you get your materials. If you go around killing people for the sole purpose of collecting fresh body parts to construct the golem then yes, you are doing evil. If you are using recently deceased bodies that you dug up then no you are creepy not evil.

Desecrating the bodies of the deceased (by removing them from their grave) isn't evil?
I mean its no puppy kicking but it's still a little evil.

Murphy-
I believe the "evil descriptor" has implications for good aligned clerics/pallys and such. It's more of a "warning sign" as opposed to forbidding the casting of the spell. Take a neutrally aligned PC for example.
That being said, I agree with uber nerd that any good aligned PC would be in poor taste to create such a construct.

It's creepy to me in game terms. It isn't evil. Different cultures feel differently about their dead. Some bury them, some burn them, some even leave them to the animals. It's all how the GM offers up the access to said parts and what each culture believes in. The actual act could be considered good or evil depending on the point of view really.

On second thought I agree, not evil but supremely creepy. Possibly against the law depending on local custom and laws.
