1) my DM is allowing everyone else in the party to use custom built races except me.
2) he is also allowing everyone else to use 3rd party classes.
3) My DM is pretty much being a prick to me for not being there every week when he KNEW before i joined that i could only be there every other week
to elaborate- about 3 weeks ago my half elf fighter died, i wanted to build a new character using the race building guide as my friend who for purpose of this discussion i will call johnny, who was allowed a 20 point build and ended up building a pretty awesome dragon type character.
he allowed 3 of the other party members to use archetypes from 3rd party publishers such as the cavalier archetype inspiring commander from rite publishing, or the paladin archetype dragon knight, but when i wished to use a vanguard, he flat out refused on the grounds that 3rd party classes are too hard to balance out.
and he is known to put my characters under mind controlling effects that i know have will saves, without giving me a chance to roll my save, he literally just says "congratulations, you're being mind controlled" and ends up killing my most epic character since my duskblade/dragon disciple from back in d&d 3.5.
if anyone can offer some suggestions on how to straighten this out without straight out quitting i would appreciate it

Asking for help on the forums is gonna help no one.
If what you are saying is true, you need to ask the DM politely why, with maturity and outside of view from other gamers, they are supposedly allowed to use some rules and you are not.You need to tell him that you are playing a game but currently not having fun as you should. That there is a reason Will saves for controlling spells are allowed, and that's because it is never fun for a player to have his character be insta-dominated by the DM to turn against his allies.
To be fair, there is a difference between archetypes and new base classes ; the balance of the first is often easier to check on.

I'll second the opinions that this is something that needs to be handled in a conversation between you and your GM. It's possible that your GM thinks you're too good at optimization and doesn't want you to wreck his carefully-crafted world, or that he doesn't like you as a person, or that he got out of bed and a voice in his head said "pick on that one guy there for a while. It'll work out fine; trust me." Whether it's one of those things, or something else, you need to speak to him to resolve it. The forums are great for lots of things, but solving personal problems at the gaming table isn't in that list.

Glad you talked to him. Maybe you can ask him to work with you to come up with a character concept that better suits his world--or ask for him for better guidelines as to what would suit the campaign before you rebuild again.
