If the party finds a scroll, a 5th level “Breath of Life,
Can that scroll be CL5? Or must it be a higher CL like CL9?

The minimum CL of a scroll is the minimum needed to cast the spell. Breath of Life is a 5th level spell, which is going to require a CL9 caster minimum. It is possible to make the CL higher, but you can't make it lower than the lowest level caster possible to cast the spell.
