Simple question:

Is a small Aether Elemental a legal Improved Familiar for an Aether Kineticist with Greater Elemental Whispers? Is it supposed to be legal?

I've asked this before in this thread but didn't really get any clarity and it started out mixed up with whether you can take an Aether Elemental as a regular Improved Familiar. They're definitely powerful, and it sounded like John didn't think it was balanced, so if it's not supposed to be PFS legal, I'd like to know.

My Kineticist just hit 6 and I'm trying to decide between Greater Elemental Whispers and At-will Invisibility!

I have a level 13 Aether Kineticist and I absolutely love having the Telekinetic Invisibility. It's such a nice tool to have in your repertoire.

I would just err on the side of caution referring to what John Compton said in your other thread. Just because you can do it doesn't mean you should.

Pathfinder Roleplaying Game: Bestiary 5

Animal Companions: The blue whale, cameroceras, ceratosaurus, chalicotherium, digmaul, kaprosuchus, moa, narwhal, plesiosaurus, therizinosaurus, troodon, and uintatherium are legal for play. Familiars: The brain mole, chuspiki, clockwork familiar, liminal sprite, wysp, xiao, and all familiars listed and pages 112-113 are legal for play; a chuspiki's air blast ability always functions as if it were a 3rd-level kineticist. Feats: None of the feats are legal for play for PCs, animal companions, or familiars unless specifically granted by another legal source. Other: All creatures in this book are legal for polymorph effects (including a druid's wild shape ability) within the boundaries of each spell or ability's parameters. All languages found in this book are available for a character to learn with the Linguistics skill..

Short answer, it is not listed, and unlike the Bestiary 1 language you can't access them via another legal source.

To be blunt John was already pretty clear, I advise against even trying to argue to a GM that it is legal.

Btw if you end up taking the invisibility ability, mention to your GM that you don't get "real" invisibility your bonus to stealth checks is significantly lower.

That's true for the Improved Familiar feat, where John was very clear and there's not an issue.

The problem is Greater Elemental Whispers is PFS legal, and specifically allows an Aether Kineticist to take a small Aether Elemental (or an Aether Wysp) as an Improved Familiar.

Based on John's post, I don't think this is intended. If it's not intended, I'm just hoping someone makes that explicit, because with the current Additional Resources, it looks legal.

I have a piggyback question related to this one, if you are a Void Kineticist do you get to pick between a Negative Energy Elemental and a Gravity Elemental?

And because Aeither Elementals are not allowed as familiars, telekineticists get an aether wysp.

Having access to a list that includes illegal choices does not mean those choices become legal. There are a few exceptions, but they are called out as such. This case is so translucent, it is clear.

while john says "A naturally invisible, flying, telekinetic throwing (based on its Hit Dice, which scales with effective wizard level) elemental makes for a delightful opponent but isn't necessarily an appropriate familiar for a PC."
he did not say it was not allowed, the additional resources legalized the feat as it is written, until a clarification is made i would assume rules as written is law. however keep in mind they may add a clarification making it illegal which will require u to change ur feat or ur familiar but till they do RAW is straight forward.
