IIRC the monster whose name will not to be mentioned is not covered under the OpenGameLiscense (much like the creature with eyes).

They do not appear as they fear the breach of copyright more than they enjoy the taste of adventurers, much like their tentacled faced friends and their often missed cats.

Not all 3.5 monsters are open allowed under the OGL. That monster is one of them so Pathfinder is not allowed to use them.
