When firing into combat (1s range increment) attacks are considered touch attacks for purposes of hitting your target. Two questions:

1 - do I take a -4 penalty firing into melee combat
2 - if my opponent is flat footed, do I get my rogue sneak attack damage if I'm less than 30 feet away?

2) Yes.

Not that just because you're targeting Touch AC with the firearm doesn't mean the target is flat-footed.

So not every shot with the firearm within the first range increment (capped at 30') will be a sneak attack, if that's what you were getting at.
