The fighter does not have a list of spells known or spells prepared to cast from. A fighter picking up a wizard's spellbook does not get the ability to cast those spells (unless he invested in UMD). So, no, he could not cast detect magic.
Doh, you are right. Bad me. I didnt read it closely enough. Mauril is right. Unless you have spells known or prepared then nope, a fighter cannot cast it.
