Medium Spirit surge and opposed checks question.

Okay, so me and my gaming group having been going back and forth for a while over an issue with the Medium's Spirit surge. The specifics of it state that "After failing a d20 roll that was modified by his spirit bonus, a medium can allow his spirit to gain 1 additional point of influence over him in order to add 1d6 to the check’s result without taking an action."

The part that we argue over is does an losing an opposed check count as "Failing" a d20 roll, with the other people in my group holding that it doesn't count as failing since there is no set DC, the other person is just doing better than you. So my question is, can you use a Spirit surge on an opposed check (Opposed charisma checks, perception vs stealth, etc)?


Opposed skill checks for certain. The skill section tells you which skill sets the DC. E.g. Stealth vs. Perception: stealth sets the DC, and Perception is the passing/failing skill. Bluff could be both.
