Mythic adventure: legendary spellcasting

We begin the Wotr campaign in 3 weeks. We are excited to play this campaign. To make it interesting, we have applied a lot of ideas of the mythic solutions pdf.

We have a last thing to define well before beginning. It's about the spellcasting ability of legendary items. We have 2 different interpretations in our group, so I would like to have your opinion on these 2 interpretations:

1) With the 5 points allowed by the spellcasting ability, you can take for example one spell of level 4 and one spell of level 1, and cast these spells once per day, each time by a standard action. You can also take one spell of level 2 (twice) and one spell of level 1. In this case, you can cast the level 2 spell 3 times per day and the level 1 spell once per day.

2) In my first example (one level 4 spell and one level 1 spell), you can cast all this spells once per day by spending one legendary point from the legendary item (you have to be able to cast the spells), or you can cast all spells of the item 3 times in the day if you spend 2 legendary points from the item.

Which version is the good one ?

The first interpretation is the correct one. By paying for the same spell twice, you get three uses from it, and only one use from any other spells. You don't need to spend any Legendary Power to activate the spells from that ability.

I have another question: does the surge ability of legendary items cost an action like the hero surge ?

The description for legendary surge says it's similar to the mythic hero's surge, so I'd say it takes a swift action as well.

I concur. Which sounds like a +1, but basically, I follow this reasoning, and there's a bit more I could say (such as how it says "similar to a mythic hero's surge ability" and then goes straight into "only on specific rolls or checks" which implies that it's now talking about how it's not similar to mythic surge.), but Khudzlin has the essence of it.
