Once you gain the permanent bonus to intelligence, you gain skill points retroactively. So if, for example, you had 50 skill points at level 10 and you gained 2 int, you would go to 60 skill points. Those 10 skill points can be spent as you wish unless otherwise noted, such as the headband of vast intelligence.

That fAQ just saws that you don't get to double dip. Because people were asking since the headband increases int, and explicitly says you gain skill ranks, would you effectively gain twice as many skills. The answer was obviously no.
But it also seems rather obvious that since the headband of vast int doesn't exist in the new system (and can only otherwise be increased by level increase to stats and wishes) that they would want the ability that replaces the item to also give skill points.
Now, what is unclear is if the skill points are all fixed into one skill, or if they can be divvied up individually. I would personally say it functions exactly like the headband, since it was meant to replace it.
But I could see an argument for allowing you to choose.
