Deeper darkness spell pg 265 says: deeper darkness can be used to counter
or dispel any light spell of equal or lower spell level. Deeper Darkness is a 3rd level spell. Day light says it dispells or counters any darkness spell of equal or lower.
1. does day light spell counter deeper darkness?
2.Continual flame is a 2nd level wizard spell it is dispelled by
both darkness and deeper darkness. But what if you have a light bringer ELF FROM THE ADVANCED PLAYERS GUIDE page 13 Light bringer Elves are treated as 1 level higher when determining the effect of any light based spell or effect
2a. If a light bring elf cast Day light is it considered to be a
3rd level spell or a fourth level spell if it is a 4th level spell would the Light bringer elves daylight spell be immune to the deeper darkness spell since deeper darkness effect light spells of equal or lower and Deeper darkness is only a 3rd level spell?
2b. There is a magic trait called called Gifted adept It says Pick one spell when you choose this trait. From this point on whenever you cast that spell it effect manifest as +1 caster level APG 329
2c If a Light Bringer Elf is a gifted adept and they choose the spell continual flame. Would the normally 2nd level spell work as a 4th level spell there for being too high to be effect by darkness or deeper darkness?
3.If a 5th level wizard has the heighten Feat core rule book 126
A Heighten spell has a higher spell level than normal up to a maximum of 9th level a heighten spell actually increase the effective level of the spell that it modify s all effects dependent on spell level
such as saving throw DCs. So he chooses to cast continual flame as a 4th level spell he has to use Magical device to cast the spell, But if successful he could create a 4th level continual flame spell.
3a Is this spell immune from being countered or dispell by a lower level
darkness or deeper darkness spell?

1. Is daylight of equal or higher level? If do then yes
2.if the caster is treated as one level higher that means level based mechanics are increased...such as how long the spell lasts. The actual level of the spell stays the same unless Heightened
2a. 2b. And 2c. See the answer to 2.
3. Yes heighten spell makes the spell actually work as a higher level

I think your confusion stems from a misunderstanding of Caster Level over Spell Level
If I'm a level 8 sorcerer with 24 Charisma...
I can cast fireball...its a 3rd level spell and my Caster Level is 8 so the fireball does 8d6 with a DC of 20 right
If I have something that increases my caster level for fire spells by 2 then my fireball does 10d6 but the DC is still 20...the damage is Caster Level based bit the DC is based on spell level and ability modifier
Now if I Heighten my fireball to 4th level...its now actually a higher level spell...has the same 10d6 damage but the DC is 21

If you cast it as a counterspell, yes. But that's pretty infeasible given daylight's range of "touch".

Yes, if the dark spell is used as a counter or dispel, but both are unlikely given the range of "touch".

You're confusing spell level with caster level. :)

Again, caster level versus spell level.

I don't understand what the Use Magic Device skill has to do with this, but you're correct; a 3rd-level spell that says it can counter or dispel a spell of equal or lower level can't counter/dispel a spell that's been Heightened up to 4th level.

Dispelling is still relevant, though.

Not to muddy the waters too much, remember that magical light sources only increase the light level in an area if they are of a higher spell level than darkness, and normal light sources do not work at all.
Because darkness spells suppress all non-magical/low level light this means that at night or indoors it will make it dark (since that would be the ambient light without outside illumination) before it even drops the light level as described in the spell. Moral of the story, indoors Deeper Darkness will make it supernatually dark just about every time.
Because of the way that light works even if you have a normal continual flame spell and someone casts darkness (2nd level) or deeper darkness (3rd level) then it will not increase the light level since both are equal to or higher level than continual flame (2nd level).
However, of you heighten said continual flame (via metamatic) to 4th level, then it will increase the light level. Assuming nighttime/indoors, this means that said light will still allow dim light after a darkness spell (normal light from the torch minus one step from the darkness, and normal vice supernatural darkness after deeper darkness (normal minus two steps).
This will allow you to go around those who spam darkness (and if they can cast it once, they can usually cast it many times) without burning your critical actions. Bonus, because a heightend eternal torch is 4th level, it cannot be dispelled (even if they can touch it) by a normal or deeper darkness, because they are lower level.
