Fly Spell Question

Rules Questions

So, this just came up in the game I'm playing in: Is the Fly spell (Or any magical flight spell, really) subject to the hover DC from the Fly skill? It seems rather silly that someone can't magically hover without making a check, especially with no wind or adverse conditions.

Yes, you have to make Fly checks to hover. Everyone that wants to hover must make a Fly check, unless they have an ability that specifically says that the check isn't needed (like the Hover feat).

It does indeed seem subject, but I don't really see a penalty for failure because your character isn't using wings.

There is nothing silly in it - it's not levitation to let you hang in air just because so so you need to make Fly checks to keep hovering. It does grant bonus equal to one-half caster level to Fly checks, however, and an additional +4 bonus due to good maneuverability.
