Magic Armor: retribution property

Hi,
I'm looking on the Retribution magical ability for armor from "The book of Divine Magic (PF)":

Retribution: Three times per day, the wearer of a suit of armor with this ability can cause the next creature who hits them and causes damage – whether by physical or magical attack – to take an equal number of points of damage of the same type.
Faint necromancy; CL 3rd; Craft Magic Arms and Armor, retribution; Price +6,500 gp.

few questions, since the text is not very specified (it potentially an extremely unbalanced powerful property):
1. does it require a standard action to active
2. 'the next creature' - means that after the ability is activated it stays activated until something attacks the wearer? for how long would it be activated ?
3. if a spellcaster hit the wearer with a fireball would he get a save roll vs. the same effect, or automatically gets the damage ?
