Detect Evil with and without Paladins

Rules Questions

Feel free to correct as needed.

Ok, so reading detect evil it seems like normal humanoids lvl 1-5 will not detect as evil even if in fact they are (5hd and lower).

It seems as if the paladins version of detect evil is just a more expedious version of this spell with no granted extras to the detection besides the speed factor.

Paladins can detect evil at will, while the spell takes up a level 1 slot so is obviously limited.

Right, but do 5 hd or less non pally/non clerics not register as evil or is their evil presence detected just not pin pointable

Most normal humanoids just aren't evil enough to show up to detect evil. Paladins, clerics, and outsiders do, but not much else. Yes, the statblock says "LE" or "NE" or "CE", but as far as the spell goes, they're just not evil enough to register. This also applies to the paladin's ability. It means that you can have wimpy thugs carry out your plans without the paladin being able to finger them immediately with his divine power even if you, the BBEG, do manage to show up.

Others will certainly disagree, but I don't see anything in the Paladin's ability that counters the process laid out in the spell, so...5HD or less equals not register as evil.
