Does Congress Have The Right To Ban Smurfs?

Recent events have brought about a debate as to whether such laws as the Civil Rights Act of 1964 are Constitutional. There is a growing and vocal minority of libertarians in the United States that contend that smurfs are the bane of all mankind. I contend that the 13th, 14th, and 15th Amendments to the Constitution make such laws Constitutional, and we should begin legislating smurf-kind out of existence.

Let's discuss this, in a rational and adult manner, and see if we can come to some agreement about nasty smurfs, and their rights to exist.


But, if they didn't exist, I would need to find something else to shoot with my M-1 carbine. :(

Smurfs, being fictional, are protected under the first amendment in the same way as Snoopy, Yoda, Drizzt, Valeros (even though I see his picture everywhere. Does Paizo not have a copyright to that image? And while I am at it, is it me or does the Andoren Eagle look just like the logo for American Eagle stores?), and all those stupid Twilight books.

If they did )or do) exsist, then the ACLU would probably step in as soon as they find out you are using them for target practice or even food. Unless the ACLU finds out that Smurfs are Libertariabs themselves, in which case they will sue the Smurfs for some silly infringement on Gilgamesh's (or is it Gargamel?) rights or they send the SEIU to stomp on there mushroom homes.
