Sexting=child porn

Ramifications: So, if I'm a 17 year old girl, take a picture of myself in the buff and email it to my 17 year old boyfriend, I'm guilty of distributing child porn, and he's guilty of receiving it... And if he's 18, he's also a sex offender...

Yeah, pretty much. Some states are passing "Romeo and Juliet" laws, to provide exceptions for the 18-year old guy with 16-year old girlfriend scenarios, but for a lot of folks it's already too late.

(Heavy Sarcasm!!) How can you say that. Think of the children. OMG what is this world comeing to when a healty girl and her long-time boyfriend want to explore each other, They should be thinking only of their studies and how to be better (insert religious belief here) not engaging in sex before marriage. (end sarcasm)

Seriously alot of good guys have been busted by this sex offender law. I know of 3 taht had girls friends in high school thye graduated turned 18 while there girls were 17 or under so the parents called the cops and they lost alot. One lost his college admittance, another his military entrance and the 3rd actually did jail time when she met him in town and the parents set up a sting. All because of a poorly written law, good intentions but poorly written.

I read this story the other day...I'm about 99% certain that the only reason charges were filed is the administration was getting their jollies off and realized she was 17, so they filed charges as a CYA.

It also reminds me of a funny article i read awhile back (no link sorry, it's been a minute). Girl tries to break up with her boyfriend, he threatens to put sex-videos of them online. She breaks up with him, he puts videos online. Girlfriend is 16, boyfriend is 19. Instant kiddy porn charges, huzzah! This is a circumstance where I believe the charges would be valid. As for sexting? Don't all these bankrupt cities/states have better things to spend their money on?

The moral of this story is that you should keep a duffle bag full of Hustlers under your bed like I did as a kid. Then you won't be tempted to look at your girlfriends naughty pictures. Cause I guarantee you that your girlfriend won't be posing like those girls do in Hustler. That little magazine has always pushed the envelope of good taste.....

But that was part of it's charm.

Agreed.

But then it turned out that the creator of "Chester the Molester" really was one....

There's been a lot of these cases nationwide over the last few years. Now, if I were their lawyer, I'd move that they be tried as adults. And then I could tell the court that if they're adults then they're not children. And if they're not children, it's not child porn. And then I'd collect a lot of money and move to Aruba before the court figured out that that didn't make any sense.

The one problem I see is that what goes on the internet doesn't always stay where you want it. There is a girl that my son knows that was involved in sexting and after she broke up with her boyfriend, he started posting the pictures everywhere he could on the web. She was 13 years old, and he even posted her name and e-mail address. Sure the penalties for sexting might be too harsh, but based on what I know we do need to do something to break this trend before someone gets hurt.

I'd say a few cases out of thousands per region doesn't equal a trend. Absolutely, the boy in question must be held accountable, but charging the girl in your story with production and distribution of child porn is extreme and ridiculous.

This made me think of something a co-worker told me. His daughter was going on a school trip that would require them to stay in a hotel for at least one night. He said the school would not allow cell-phones to be taken on this trip. That struck me as odd. I thought cell phones would be useful in case there was an emergency with the kids so far from home.

He said the school officials explained that they feared mis-use of the cameras. Imagine if a kid steps out of the shower and then "click". Seconds later there could be photos of a naked juvenile on the Web. Suddenly the kid taking the photo could be down the path of becoming a registered sex-offender for producing child-porn. And then there is the matter of the school's liability in any subsequent litigation.

As for the "Chester" revelation: I am not surprised. Even as a kid I did not think it was funny.

Which I agree with. However, I also believe that something should be done. Otherwise a few cases are going to turn into lots of cases. Let me give you another example.

I have a friend who works in the cyber-sex crimes division of the UBI, our states version of the FBI. On a regular basis they find webcam sessions that underage girls have used to put on little shows for their boyfriends that have made it onto the computers of pedophiles. When they have been able to track the kids involved down, 9 times out of 10 the kids claim that they have no idea how other people got a hold of their "private stuff."

The problem is that phone lines and the internet are not as secure as people think they are. Unless you encrypt the data and only the person receiving it has the decryption key, anyone with the right equipment can grab you transmission and watch it. Therefore we need to educate kids that if they are going to do that, which I do not condone, there are safer and more secure ways to go about it.

Ahhh, I had maybe 20 mags in there at any one time. The 80's were the heyday of porn magazines: Velvet, Cheri, Swank, Club, High Society, just to name a few besides the Big Three (Playboy, Penthouse and Hustler). I always used to wonder just how many women were willing to pose for nudie pictures (not that I was complaining).

But you are right, the stuff out there on the web now is crazy. You don't have to be a professional model anymore to be a "star" on the web. Now instead of a duffle bag, you just need a bookmarks list. Course now that I am happily married, the duffle bag is gone and I (hardly ever)/never surf adult content....

Disclaimer: I have never, and never will, condone underage porn. That stuff is vile. I like extreme gore horror movies, doesn't mean I want to see videos of real violence. Just to be clear; the lines get blurry sometimes, but I think anyone that traffics or enjoys "kiddie porn" is scum of the earth and should be roasted over a slow-cooking fire (along with hackers, identity-thieves, Wall Street Executives and Dick Cheney).

The tears of the innocents, of course.

This came in discussion with friends of mine a couple of years ago. The idea that laws meant to protect children can be used to ruin the lives of the very children they supposedly protect...erg. It makes my head hurt.
