Are they part of the OGL? If so is playing an intelligent sentient construct a copyright infringement?

I see the construct phenomenon named warforge occurring in other worlds besides Eberron.

No, in fact you can just pick up your Eberron book and play out of it. Or roll your own.

The problem with warforged in a non-ebberon world is that there are no rules and few challenges designed with them in mind. Poisons, drowning, sleep effects...

At higher levels it's less of an issue.

Warforged are the intellectual property of Wizards of the Coast, and are not open under the Open Game License. For that reason, you will not see them appear in any Paizo publications.

However, simply playing them in your game is a matter between you and your DM, not a copyright court.

If you're looking for an open alternative, I think Wolfgang Baur's Zobeck books have the 'Gearforged', which are a OGL construct race. I think it's meant for PCs, but I'm not certain because I haven't read the book in question.

Yup. Gearforged are in the Zobeck book. They're clockwork constructs with a living creature's soul bound to them, sometimes voluntarily, sometimes not. They are a LA +0 race meant for pc's.


Mulhavoc (monte cook) has a Book of Iron Might that had something similar to warforged. I don't know if it's OGL or if it's all that great, I don't have the book unfortunately, but I know I've never had a problem with any of their products.

I'm pretty sure Rogue Modrons are. But I'd have to triple check.

Modrons are also WotC IP... so they're out.

They are OGC. Thanx for reminding me that I actually own the PDF. Had to re-download it from RPGNow, lol. Now I have my "warforged" for my campaigns. Think I will tag them living construct. No that type isn't OGC, but I have seen other companies that have used it before. I think I saw one that predated the Eberron Campaign.
