I actually really like legendary class DC, I just think that a more elegant way to do Burn would be to get a choice to lose HP and max HP equal to your level until your next daily prep when you Gather Energy, then treat it like a Swashbuckler's Panache in terms of damage - basic blasts deal extra damage equal to your CON mod, and your next Overflow action deals 1d6 extra damage (increasing by 1d6 every four levels to a max of 5d6 at 17th level).

What if Kineticists got the option to voluntarily increase their Drained condition by 1 until their next daily prep as part of the action to Gather Energy, and then got to add their CON mod to damage to their basic blasts as long as they have that element gathered? Also, while they have that element gathered, add CON mod/d6 damage to your next Overflow action, kind of like how swashbuckler's Panache works - Overflow actions would be the analogue to Finishers, and the CON mod to damage on the basic blasts would work like the swashbuckler's precision damage with Panache.

This would give kineticists a mechanic that makes a high CON important, would give the opportunity for big burst damage limited by the kineticist's health, and would give them the ability to add CON to damage while actually capitalizing off of having 18 CON at level 1. Essentially, this is a way to implement Burn while keeping the mechanic simple enough for new players to understand, while keeping in line with existing design precedent.

If Paizo is dedicated to having CON as the Key Ability Score, then kineticists need to be able to add CON to damage, since that would be a reasonable trade-off for being effectively -1 behind other martials for most of the game.

Alternatively, allow them to take STR or DEX as their key ability score so they can actually hit things with Elemental Blast.

CON key ability score with no core features that actually use CON is a bit weird - like maybe grant the ability to use Overflow actions without Gathering for 1 point of drained?

I was looking through the subconscious minds, and I saw that Silent Whisper psychics get Sending (notably a 5th-level spell) as the 6th-level spell granted by their subconscious mind. This is really strange, because to my knowledge, there isn't any precedent for a subclass granting a heightened version of a spell, much less a spell without a heighten benefit. Given that there's no reason to cast Sending at 6th level, isn't this really strange? I also looked at the playtest document, and it's the same there - given that this violates precedent for granted spells from subclasses (like sorcerer bloodlines and conscious minds), I strongly believe that this is an error that managed to sneak through the review process. Can someone else check on this just to make sure?
