So looking at encounter building I think if I want use a NPC against my party i can build them as normal character... so a 3rd level NPC fighter would be a normal threat for a 3rd level group of 4. True?
If so do I use the same death and dying rules for them? Meaning things like diehard come into effect?
Just wondering if people have used it this way

If you build an NPC w/ player rules, you're making a threat of the same level. Level 3 Fighter=Level 3 Monster.
Whether that's appropriate depends on what difficultly you're aiming for.
Treat them as any other monster for determining that.
The death & dying rules are not based around the classes or ancestries, but on whether a creature is a PC or NPC. PCs & important NPCs (or NPCs temporarily important enough to live) use those rules. Disposable creatures simply die (or get destroyed, whatever).
Diehard would be useful if you need the NPC to survive, perhaps to pass on information to the PCs. Otherwise it's useless.
I guess an exception could be made if you have an enemy Cleric who keeps casting Heal on their allies! That's not that great on an unconscious ally though because they're prone and have dropped their weapon (as well as have lost Rage/Stance/etc.) But it could be a one time trick for giggles.
