Preferred Spell and Spell Recall

A magus uses Preferred spell to sacrifice his Fly spell for an Empowered Shocking Grasp.

After the battle, he wants to use Spell Recall on that spell slot. What comes back, and how many points from his Arcane Pool does it cost?

1. Empowered Shocking Grasp comes back and it costs 1 point from his arcane pool, because Shocking Grasp is a level 1 spell.

2. Fly comes back, and it costs 3 points from his arcane pool because Fly is a 3rd-level spell.

3. Other, explain.

And if he had memorized an empowered shocking grasp it would still count as a third level for this and for pearls of power

No, it would not. That rule is pretty clear. Spell Recall is determined by the level of the spell specifically, not the spell slot used. Since an Empowered Shocking Grasp is still a 1st-level spell, it costs 1 ap point to recall.

The ambiguity comes in when you are getting that Empowered Shocking Grasp by sacrificing another spell that actually is 3rd-level, and which spell is actually recalled.

And yet it would take a 3rd level pearl of power to recall it rather than a 1st level pearl. I would think that with the myriad of ways that 'level' can be interpreted here, that was meant here was 'slot level'.

There is no ambiguity in the other case as you never prepared the empowered shocking grasp, did you?
