Is it legal to take a 5' step when getting up from prone?


No because standing up from prone is a move equivalent action, thus no 5 foot step

Yes, as you haven't actually moved from your square (just used a Move action to Stand) you can take a 5' step.

I believe "other kind of movement" in the sentence "You can move 5 feet in any round when you don't perform any other kind of movement" is meant to refer to the actions of Move (including climb, swim etc), Run, Withdraw and Charge etc - not Stand Up.


As others have noted, yes. But you must stand first, provoke the AoO for doing so, and then 5' step.


Indeed you can, because a move action is not the same as movement.
If they wanted to disallow it, they'd have to reword the sentence to state "You can move 5 feet in any round when you don't perform any other move actions."

The combat rules define movement as moving your speed, or equivalent action such as flying, climbing, or swimming. It further defines move actions as a seperate action that simply requires an equivalent amount of time to perform. It cements the distinction by saying you cannot take a 5 foot step in a movement mode you don't have a speed for.

Meaning you cannot take a 5 foot swim if you don't have a swim speed, or a 5 foot flight without a fly speed. It's definitely targeting MOVEMENT MODES and not MOVE ACTIONS.

As above, just be aware that you are going to provoke an AoO prior to that 5 foot step by standing from prone.
