Definitely. The victim can't become a vampire, as the OP said. The vampire can either elect to make it a vampire spawn, or not use her Create Spawn ability at all.
If the vampire wasn't a humanoid in life, she can't create vampire spawn, since they must be made from humanoids and the vampire's Create Spawn only works on her own former type.
