I humbly submit my predicament to the RulesGods...
So I am Loving DSP-Psionics Unleashed and the Elocater PrC
ScornEarth, iconic Elocater ability, is bound loosely by Levitate SpellRules, (ie iterative attack penalties).
I was thinking that wouldn't a DC 15 Hover-Fly SkillCheck be useful to negate these cumulative penalties as a "no" or free Action? or somekind of Fly skillcheck(really the Elocater has awesome fly checks)
It just Seems that an Elocater who is master of his body's position in the universe, should be able to stabilize himself without a thought.
any thoughts? It was recieved warmly on the DSP board, but i was pointed here to possibly get some feedback on the original rules as the psionic power DefyGravity is based on Levitate and those rules govern ScornEarth...

Um... generally we don't answer rule questions about 3pp here...and I haven't a foggiest about what you are talking about. I would suggest you look down in the 3pp forum section and hope for help there -- not out of rudeness or "you aren't supposed to be here" but because I think you'll find help there easier.

Its not so much the 3pp question as it just a question about the Levitate spell...using fly checks to negate the cumulative attack penalty from attacking while levitating

I think the gist is "Here's an idea to errata Levitate, based on the idea I came up with for the equivalent psionic power". Which would belong here.
Specificially, he wants to allow a Fly skill check to negate the penalty to attacks while levitating:
A levitating creature that attacks with a melee or ranged weapon finds itself increasingly unstable; the first attack has a -1 penalty on attack rolls, the second -2, and so on, to a maximum penalty of -5. A full round spent stabilizing allows the creature to begin again at -1

Ah, I see now -- I'm still not sure what to say here -- it isn't really a question but more like a suggestion of a change. Technically Levitate is more akin to being in an unstable elevator (magical) than it is to flight, since it doesn't actually give anything other than vertical control. My understanding is it's a bit like one way nul-gravity -- you literally have nothing to brace off of to brace yourself (unlike with flight where you still have gravity to contend with and the "lift" of your flight mechanism to brace off of).
So I'm not sure that the fly skill would actually help you any in this case.
