According to the bestiary, the Wyvern is a 10 lv creature for the purpose of determining what leadership score you need to gain it. Does this also mean you need to be level 12 to take it as a cohort, or can you be level 9, since the Wyvern has 7 HD. Also Is the Wyvern treated as being level 7 or 10 for the purpose of how much XP it needs to gain a level?

You would need to be level 12 or higher to recruit a level 10 cohort.

I personally have a problem with the cohort levels assigned.

They don't equal the character level if you make the monster as a PC.

Personally, in my game, I use the PC monster rules to determine the character level for the monster.

If I can have a 12th level cleric as a cohort, I should be able to have a 10th level Minotaur as a cohort (or 11th level, depending on how you rule the 1/2 CR reduction for leveling). I believe Minotaur's are CR 3 if I remember correctly.
