if using a spell storing ring you put in a maximised fireball.
would it be classed as a lvl 5 spell or a lvl 3 spell

Actually, it'd be a 6th level spell for the purpose of storing in a ring, since Maximize is a +3 Spell Level adjustment. An Empowered Fireball (+2 Spell levels) would be a 5th level spell for purposes of a ring of spell storing.

so i take it the dc would be 10 + 6 (spell lvl) plus int mod.

A metamagic feat doesn't improve the DC unless the feat is Heighten Spell, so the maximized fireball DC is 10 + 3 + relevant ability mod.

For non-staffs, the relevant ability mod is always the lowest it could possibly be. A fireball requires Int 13, so the ability mod is +1, and a wand of fireball's DC is 14.

For a ring of spell storing with a Maximized fireball, the DC should be 10 + 3 + 3 (since you need Int 16 to cast a 6th-level spell), or 16.
